1. ABOUT US

WowTown.com (the “Site”) is operated by China Industries Limited which trades as Wow! Stuff and is a limited company registered in England and Wales with company number 04989385, our registered office address in the UK is at Creative Industries Centre, Wolverhampton Science Park, Wolverhampton, West Midlands WV10 9TG.

The Site is the video site just for kids. By providing a safe, moderated community we aim to encourage children to be creative by filming fun videos of them playing with the latest toys and games. These videos can be uploaded to the site and shared with other “Wowzers” throughout the world who can watch, comment and interact in a secure environment.

When we use the words “we”, “us” and “our” we mean China Industries Limited.

2. THE TERMS OF USE

Please read these terms of use very carefully before you start to use the Site as they govern the terms on which you use the Site as a visitor to the Site. When you start using the Site you indicate that you accept these terms and agree to them. If you do not understand anything in these terms of use, please contact us to ask for further details or clarification.

As a visitor, you can access the Site on a temporary basis. If you are under fifteen (15) years old and you want to become a registered user of the Site so that you can upload videos and comments, you can do so by creating an account with us. We will need your parent or your guardian’s approval before we can open an account for you and both you and your parent or guardian will also need to read our terms and conditions for registered users and our privacy policy and your parent will need to agree to be bound by these. If you are already fifteen (15) years old or more, then unfortunately you cannot become a registered user of the Site, but you can sign up to receive our newsletters from time to time.

If you are a parent or guardian of a registered user you must supervise and monitor your child’s use of the Site at all times.

3. USING THE SITE

We want you to enjoy using the Site and to make the most of its features. However, you agree that you will comply with the restrictions on the use of the Site as set out below:

You agree:

  1. you will not use the Site or its features in such a way that it interrupts, damages or renders the Site or its features less effective.
  2. you will not use the user name or password of another user or attempt to impersonate another person.
  3. you will not use false or inaccurate or out-of-date information in order to set up an account to use the Site.
  4. you will not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.
  5. you will not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site.

4. ACCESS TO THE SITE

  1. Access to the Site is permitted on a temporary basis and we reserve the right to withdraw or amend the services or features of the Site at any time without notice to you.
  2. If you are in breach of any of these terms of any other applicable laws, we can without notice restrict or deny your access to any parts or all of the Site. If we terminate your access to the Site, you agree to stop using the Site and its features immediately. Please note that this does not limit any other rights we may have, including taking legal action to defend our rights or those of another person.
  3. We will not be liable if for any reason the Site is unavailable for any time or for any period. From time to time we may also have to restrict access to some parts of the Site or our entire Site to visitors to the Site.
  4. You are responsible for making all arrangements in order for you to access the Site and ensuring that you are able to comply with the relevant system requirements that must be met for you to be able to access the Site and use any of the features on it.
  5. We do not accept any responsibility or liability for any lack of functionality of the Site or failure to provide its features or services if this is due to your equipment, for example, your Internet connection or device or software settings.

5. OUR CONTENT ON THE SITE

  1. We confirm that we are the owners of or have permission to use any intellectual property which features on the Site and the material that we publish on it. The material on the Site is protected by intellectual property laws applicable in the United Kingdom. You cannot use any of our intellectual property without our permission. Where our trademark or logo appears on the Site, this remains our property and we do not grant you permission to use our trademark or logo by your use of the Site in any way.
  2. You may print off one copy, and download extracts (other than videos, which you must not download), of any pages from the Site for your personal use only.
  3. You must not modify any copies of any materials you print off or copy in any other medium any content on the Site.
  4. You cannot under any circumstances use any of the materials on the Site for any commercial purpose unless we have given you express permission to do so.

6. INFORMATION POSTED ON THE SITE

Any comments posted on the Site or comments in videos featured on the Site are not intended to amount to advice on the products featured or commented on. They are the opinions of the persons in the videos and posting comments only. We do not endorse any of those opinions or comments and we disclaim all liability and responsibility arising from any reliance placed on those comments or videos by any visitor to the Site or anyone who may be informed of its contents.

We would be surprised if you found any video content or comments on the Site in any way indecent, harmful or offensive, as we will police all material before it appears on the Site. However, if you have any complaints about another user of the Site or of any information posted on it then please notify us immediately by contacting us at Support@WowTown.com.

Some of the material on the Site may be out of date at any given time and we are under no obligation to update that material.

7. USE OF HYPERLINKS

You may draw the attention of others to material posted on our Site by including hyperlinks provided that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

  1. You must not establish a link in such a way which suggests any form of association, approval or endorsement by us.
  2. We are in no way responsible for any links to the videos or comments on the Site which you link via another website.

8. OUR LIABILITY

The material displayed on the Site is provided without any guarantees, conditions or warranties as to its accuracy or our endorsement.

To the extent permitted by the laws of England and Wales, we expressly exclude any conditions, warranties and other terms which may be implied about the Site and its activities.

To the extent permitted under the laws of England and Wales, we exclude all and any liability for any direct, indirect or consequential loss or damage of any kind incurred by any user or visitor to the Site in connection with their use of the Site or their inability to use any features of the Site.

This does not affect our liability for death or personal injury arising from our negligence or misrepresentation or any other liability which cannot be excluded or limited under the laws of England and Wales.

9. LAWS AND JURISDICTION

These terms and conditions are governed by the laws of England and Wales and the jurisdiction of the English courts shall apply in the event of any dispute.

10. VARIATIONS TO THESE TERMS

We may revise these terms of use at any time. We expect you to check this page from time to time to take notice of any changes we make, as they are binding on you.
