Video Competition Terms & Conditions
About Us
WowTown.com (the “Site”) is operated by China Industries Limited which trades as Wow! Stuff and is a limited company registered in England and Wales with company number 04989385, our registered office address in the UK is at Creative Industries Centre, Wolverhampton Science Park, Wolverhampton, West Midlands WV10 9TG.
The Site is the video website just for kids. By providing a safe, moderated community we aim to encourage children to be creative by filming fun videos of them playing with the latest toys and games. These videos can be uploaded to the Site and shared with other “Wowzers” throughout the world who can watch, comment and interact in a secure environment. We split up the Site into different categories and each video uploaded to the Site by us is assigned to a particular video category out of those that we are running at that particular time.
When we use the words “we”, “us” and “our” we mean China Industries Limited.
When we use the words “you” or “your” we mean the parent, guardian or other person who has received an “approval email” from us in respect of a person who has applied to activate an account with the Site and when we use the words "your child" we mean the person who has applied to activate an account with the Site.
About the Video Competition
We want the videos uploaded to the Site to be creative and fun. To encourage this, we will run a free of charge, monthly video competition and give away a brilliant prize to the Wowzer who has submitted our favourite video in each one of our video categories each month.
The competition will work like this: every month, for each video category that we have on the Site, we will pick our favourite video from those that have been uploaded to the Site in that category and we will give the Wowzer who submitted that video an 8GB iPod Touch, assuming that their parent or guardian has accepted the competition terms and conditions on their behalf and that they have both stuck to those terms and conditions. Then, at the end of each year, we will pick our favourite video from all of the previous winning videos across all categories in that year and give the Wowzer who submitted that video a 16GB iPad 2.
The competition terms and conditions are set out below. Please read them carefully before you accept them. We also recommend that you print off a copy and read them with your child.
By clicking to accept the competition terms and condition you confirm that you are happy for those videos which your child sends to us and which we upload to the Site to be entered into our monthly competition. You also agree that you have read these competition terms and conditions before accepting them and that you will comply with and will procure that your child will comply with these competition terms and conditions at all times. You will be responsible for your child’s compliance with them.
Good luck!
The Terms and Conditions
1. When will the selections take place?
The selections for the monthly competition will take place monthly. During the first week of month we will pick our favourite video from the entries that were uploaded to the Site during the immediately preceding month. For example, the selection in the week commencing 2 January 2012 will be in respect of videos uploaded between 00:01 on 1 December 2011 (GMT) and 23:59 on 31 December 2011. In this regard please note that we will upload to the Site videos that are submitted to us in accordance with section 3 (b) of the terms of use for registered users. Only videos that are actually uploaded during the relevant month will be considered in that month’s selection.
The selections for the yearly competition will take place yearly. We will pick our favourite video in respect of the winning videos across all categories from the immediately preceding year.
2. How can your child enter?
All your child needs to do to enter our competition is become one of our registered users (you will have to confirm that you accept our terms and conditions for registered users and privacy policy on your and your child’s behalf), make sure he or she has sent us at least one fun and creative video (the video must comply with these competition terms and conditions – especially section 5) in the relevant month and make sure that you have provided your consent to him or her taking part in the competition (you will have to confirm that you accept these competition terms and conditions on your own behalf and on your child’s behalf).
3. How many times can your child enter?
Your child can send as many videos to us as he or she wants and if you have agreed that such videos are to be included in the competition (see section 2 above) each video that is submitted by him or her and uploaded by us will be considered by us when we select our favourite video. However, in order to make sure that as many Wowzers as possible have a chance to win a monthly competition, your child can only win one competition, in one category, even if he or she submits videos in more than one category each month. Also, once your child has won one monthly competition we will not allow your child to win another monthly competition until 6 months have passed. Your child can still send videos to us during this period (and we hope they do), we just won’t consider them in our competition, so that somebody else has a chance to win. If your child has won a monthly competition he or she will automatically be entered into the yearly competition.
4. How will winners be selected?
Each month we will choose our favourite video in each of our video categories, based on what we think is the most fun and creative video that was uploaded during the previous month, in each category. This decision will be totally at our discretion and subject to sections 4, 10 and 12 below, our decision will be final.
Only videos that have been uploaded to the Site and which comply in all respects with the terms and conditions for registered users will be considered in the competition. In this context, we remind you that under the terms and conditions for registered users we reserve the right to review all video content before we upload or post them to the Site and to refuse to upload or post any material which we consider is inappropriate for the intended users of the Site, in all cases at our absolute discretion.
We reserve the right to choose into which video category we upload your child’s video. Whilst we ask your child into which video category he or she thinks his or her video should be uploaded, we may disagree with his or her choice and put the video in a different category. Again, this decision will be totally at our discretion and our decision will be final.
We also reserve the right to check the eligibility of entrants and videos and we may require you to give us such information about your child and his or her entry as we think is necessary to verify the eligibility of your child’s entry. We may even withhold the prize until we are satisfied with the verification.
5. How will you know if your child has won and how will your child be able to claim his or her prize?
If your child wins we will notify you by email within a reasonable time of us making our selection. You will then need to provide us with a telephone number so we can contact you for eligibility reasons (see section 4 above) and a postage address so that we can post your child’s prize to that address.
6. What happens if we cannot contact you or if you do not claim your child’s prize?
If we cannot contact you using the email address we have for you, or if you do not claim your child’s prize within thirty (30) days once we have contacted you, or if you decline your child’s prize, we will deem the prize as unclaimed or declined and we may select another winner, based on our next favourite uploaded video uploaded in the relevant month. We will not be responsible if you fail to claim your child’s prize.
7. Who can enter?
The competition is open to all of our Wowzers, so it is open to your child but only if you have provided your specific consent to your child entering and have expressly agreed to these competition terms and conditions by accepting them as part of the registration process. You must be aged 18 years or older to provide consent for your child to enter. The competition is not open to our employees, to any employees of our subsidiary companies, their families, agents or anyone else connected with this promotion. We will not accept any third party entries, bulk entries or entries submitted by agents.
8. Could the prize change?
Possibly - we reserve the right to provide substitute prize(s) of a similar value should the specified prize(s) become unavailable for reasons beyond our control. Cash or credit alternatives will not be offered. None of the prizes are transferable.
9. What will we do if we suspect fraud?
If we suspect that fraud, abuse, and/or an error affecting the proper operation of the competition has taken place, we reserve the right to end or suspend the competition, to amend these terms and conditions, to cancel or declare void the notification of winner(s), and/or to award a prize to another Wowzer.
10. If your child wins a prize in the competition will we ask you or your child to do anything?
In addition to claiming your child’s prize, we may ask you and/or your child to participate in publicity connected with the competition.
11. How can you obtain a list of the winners?
You can obtain a list of the names of the parents of winners of the competition by sending a signed handwritten request along with a stamped self-addressed envelope (detailing your request) to us. Our contact details are set out above.
12. Can we cancel or amend the competition?
Whilst we hope that we will not have to, we do reserve the right to suspend, cancel or amend the competition, including the yearly competition and/or to review and revise these terms and conditions at any time without giving you prior notice. If your child subsequently continues to take part in the competition, you will be deemed to have agreed to any such new or amended terms. Such suspension, cancellation or amendment or revised terms will be made available on the Site.
13. What conditions, promises and liabilities do we exclude?
To the extent permitted by law, we exclude all and any conditions, warranties and other terms which may otherwise be implied about the competition.
To the extent permitted by law, we exclude all and any liability for any direct, indirect or consequential loss or damage of any kind incurred by you or your child in connection with the competition or your child’s inability to enter into the competition.
In particular, we are not responsible for misdirected, lost, late, incomplete, illegible, undeliverable entries, technical hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect your child’s ability to participate in the competition. We are not responsible for other errors or difficulties of any kind, whether human, mechanical, electronic, computer network, typographical, printing or otherwise, relating to or in connection with the competition, including without limitation, errors or difficulties in connection with the administration of the competition, the processing of entries, the announcement of prize(s) or in any competition-related materials.
The terms of this section 13 do not affect our liability for death or personal injury arising from our negligence or any other liability which cannot be excluded or limited under the law of England and Wales.
14. What law governs the competition?
The competition is governed by English Law and is subject to the exclusive jurisdiction of the English courts.
