Terms and Conditions of Use for Registered Users

1. ABOUT US

WowTown.com (the “Site”) is operated by China Industries Limited which trades as Wow! Stuff and is a limited company registered in England and Wales with company number 04989385, our registered office address in the UK is at Creative Industries Centre, Wolverhampton Science Park, Wolverhampton, West Midlands WV10 9TG.

The Site is the video site just for kids. By providing a safe, moderated community we aim to encourage children to be creative by filming fun videos of them playing with the latest toys and games. These videos can be uploaded to the site and shared with other “Wowzers” throughout the world who can watch, comment and interact in a secure environment.

When we use the words “we”, “us” and “our” we mean China Industries Limited.

When we use the words “you” or “your” we mean the parent, guardian or other person who has received an “approval email” from us in respect of a person who has applied to activate an account with the Site and when we use the words "your child" we mean the person who has applied to activate an account with the Site.

2. THE TERMS OF USE

Your child has applied to activate an account with the Site and become a registered user of the Site. We will not open your child’s account until you have ticked the relevant boxes on our approval page and clicked the “confirm account” button to show that you are happy for us to do so.

Please read these terms of use very carefully before you approve the opening of your child’s account as these terms of use govern the terms on which you and your child use the Site. We also recommend that you also print off a copy of these terms of use and read them with your child.

By clicking the “confirm account” button to approve the opening of your child’s account, you agree that you have read these terms and of use, that you accept and agree to be bound by these terms of use and that you will procure that your child will comply with these terms of use at all times when using the Site. You will be responsible and liable for your child’s compliance with them. If you do not understand anything in these terms of use, please contact us to ask for further details or clarification.

3. THE REGISTRATION PROCESS

  1. Your child has already started the registration process for opening an account. They have chosen a user name (a Wowzer name) and a password and they have provided us with their first name and date of birth, your name and email address and where they heard about WowTown.com. They may also have provided us with their email address and the country and area in which they live, which were optional.
  2. Any information which your child has provided to us so far or provides to us in the future is subject to our privacy policy and any information which you provide to us is also subject to our privacy policy. If you choose not to approve the opening of your child’s account, we will delete your and your child’s personal information in accordance with our privacy policy.
  3. If you approve the creation of your child’s account, we will send you a confirmation email to tell you that the registration process is complete. Your child will then be able to upload videos to the Site or comment on videos displayed on the Site.
  4. You must supervise and monitor your child’s use of the Site.
  5. You confirm that your child is aged under fifteen (15) years old.

4. USING THE SITE

We want your child to enjoy using the Site and to make the most of its features. However, it is very important that your child complies with the restrictions on the use of the Site as set out below:

(a) Your child’s user name and password

  1. Your child’s user name (Wowzer name), should not be in any way similar to his or her actual name, but something fun and inventive. It must not be rude or use any bad language. If we consider that it is rude or does use bad language, we will not let your child register that user name and he or she will have to choose a different user name which we consider appropriate for the intended users of the Site.
  2. You promise that your child will keep his or her user name and password confidential as any activities that he or she carries out on the Site are under his or her own name. We cannot check whether it is your child or someone else using their details to carry out these activities and so your child (and therefore you) will be responsible for them.
  3. You will procure that your child will tell us as soon as possible if he or she becomes aware that someone may have used his or her password or user name without permission.

(b) uploading videos to the Site

If your child wants to upload any videos to the Site, you promise that:

  1. you or your child will have obtained permission from any person featuring in the video to do so.
  2. any videos which your child uploads will not contain any content which is rude, includes bad language, inappropriate behaviour or which may be defamatory (which means it may damage the reputation of another person) including, without limitation, another toy manufacturer.
  3. the format of the video will be compatible with one of the following: MPEG4, 3GPP, MOV, AVI, WMV, FLV, MPEGPS, 3GP, MP4, SWF, MKV.
  4. you or your child own all the rights there may be in the videos that he or she uploads.

If your child uploads a video onto the Site, it will be uploaded to YouTube which is hosting the videos for us. YouTube is a video-sharing website on which users can upload, share, and view videos. We use the YouTube platform to host the videos submitted to the Site using our channel WowTownVideos. By approving your child’s account you permit us and you promise that your child permits us to upload any videos that your child uploads to us, to YouTube. We are bound by YouTube’s terms about using this facility, but the videos which we upload will not be accessible to people searching on You Tube or any other website directly. The videos can only be accessed by using a direct YouTube link or by clicking on the video within WowTown.com.

We will not be making any videos available for download by third parties. However, the Internet is not fully secure and there are software programs that have been developed which enable information to be downloaded from websites, even where downloading is not offered. Because of this we cannot guarantee that any videos submitted by your child will not be downloaded by a third party using such software programs and we will not be responsible to you or your child if any videos are downloaded using such software programs.

(c) Posting comments on the Site

If your child wants to post any comments on the Site, the same rules apply, that they must not post anything which is rude, uses bad language or may be defamatory and you will procure that they will not do so.

We will review all video content and comments before we upload or post them to the Site. We will not upload or post any material which we consider is inappropriate for the intended users of the Site.

We reserve the right not to post any comments or upload any videos which your child provides and the right to remove any comments that have been posted or videos that have been uploaded, in all cases at our absolute discretion.

We also reserve the right to edit or cut any videos which your child uploads before we feature them on the Site for the purpose of making the video usable on the Site. This will usually be no more than trimming the start and/or end of the video - we will not substantially alter the content of the video.

(d) Use of the Site generally

You agree that:

  1. neither you nor your child will use the Site or its features in such a way that it interrupts, damages or renders the Site or its features less effective.
  2. neither you nor your child will use the user name or password of another user or attempt to impersonate another person.
  3. that the information and details you and/or your child provide to us are accurate and up to date.
  4. neither you nor your child will misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.
  5. neither you nor your child will attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site.

5. ACCESS TO THE SITE

  1. Access to the Site is permitted on a temporary basis and we reserve the right to withdraw or amend the services or features of the Site at any time without notice to your child or you.
  2. If you are or your child is in breach of any of these terms of any other applicable laws, we can without notice restrict or deny your child access to any parts or the entire Site. If we terminate your child’s access to the Site, you agree to procure that your child will stop using the Site and its features immediately. Please note that this does not limit any other rights we may have, including taking legal action to defend our rights or those of another person.
  3. We will not be liable if for any reason the Site is unavailable for any time or for any period. From time to time we may also have to restrict access to some parts of the Site or our entire Site to registered users or other visitors to the Site.
  4. You are responsible for making all arrangements in order for your child to access the Site and ensuring that your child is able to comply with the relevant system requirements that must be met for your child to be able to access the Site and use any of the features on it.
  5. We do not accept any responsibility or liability for any lack of functionality of the Site or failure to provide its features or services if this is due to your equipment, for example, your Internet connection or device or software settings.

6. OUR CONTENT ON THE SITE

We confirm that we are the owners of or have permission to use any intellectual property which features on the Site and the material that we publish on it. The material on the Site is protected by intellectual property laws applicable in the United Kingdom. Neither you nor your child may use any of our intellectual property without our permission. Where our trademark or logo appears on the Site, this remains our property and we do not grant you or your child permission to use our trademark or logo by your use of the Site in any way.

Your child may print off one copy, and download extracts (other than videos, which your child must not download), of any pages from the Site for his or her personal use only.

Your child must not modify any copies of any materials he or she prints off or copy in any other medium any content on the Site.

Neither you nor your child may, under any circumstances, use any of the materials on the Site for any commercial purpose unless we have given you or your child our express permission to do so.

7. INFORMATION POSTED ON THE SITE

Any comments posted on the Site or comments in videos featured on the Site are not intended to amount to advice on the products featured or commented on. They are the opinions of the persons in the videos and posting comments only. We do not endorse any of those opinions or comments and we disclaim all liability and responsibility arising from any reliance placed on those comments or videos by any visitor to the Site or anyone who may be informed of its contents.

We would be surprised if you or your child found any video content or comments on the Site in any way indecent, harmful or offensive, as we will police all material before it appears on the Site. However, if you or your child have any complaints about another user of the Site or of any information posted on it then please notify us immediately by contacting us at Support@WowTown.com.

Some of the material on the Site may be out of date at any given time and we are under no obligation to update that material.

8. USE OF HYPERLINKS

Your child may draw the attention of others to material posted on our Site by including hyperlinks provided that he or she does so in a way that is fair and legal and does not damage our reputation or take advantage of it.

  1. Your child must not establish a link in such a way which suggests any form of association, approval or endorsement by us.
  2. We are in no way responsible for any links to the videos or comments on the Site which your child may link via another website.

9. OUR LIABILITY

The material displayed on the Site is provided without any guarantees, conditions or warranties as to its accuracy or our endorsement.

To the extent permitted by the laws of England and Wales, we expressly exclude any conditions, warranties and other terms which may be implied about the Site and its activities.

To the extent permitted under the laws of England and Wales, we exclude all and any liability for any direct, indirect or consequential loss or damage of any kind incurred by any user or visitor to the Site in connection with their use of the Site or their inability to use any features of the Site.This does not affect our liability for death or personal injury arising from our negligence or misrepresentation or any other liability which cannot be excluded or limited under the laws of England and Wales.

10. LAWS AND JURISDICTION

These terms and conditions are governed by the laws of England and Wales and the jurisdiction of the English courts shall apply in the event of any dispute.

11. VARIATIONS TO THESE TERMS

We may revise these terms of use at any time. If we do change these terms, we will notify you by email and you will be bound by the new terms if your child continues to use the site after our email notification of a change to these terms.
